Personal Liability

 

Florida law states that employees and agents of the state and its subdivisions (i.e. any unit of local government) are not personally liable in tort for injuries or damage resulting from his or her actions in the scope of employment.  The employees and agents must not act “in bad faith or with malicious purpose or in a manner exhibiting wanton and willful disregard of human rights, safety, or property.” Florida Statute § 768.28(9)(a)
